Bad Check Cases: Represented hundred of cases involve casino markers, “returned” or “bad” checks with the Bad Check Diversion Unit of the District Attorney’s Office.
If not negotiated properly and timely, the District Attorney’s office will issue a Warrant for your arrest. Taking care of this early will prevent detention
and bonding problems. If detained, the Court will ask you to post a 100% cash bail or ten times that amount for a bail bond.
Battery: Even kissing someone without their consent can lead to your arrest. Often,
the unintentional touching of someone without their consent can result in a situation.
Burglary: Burglary occurs whenever you plan to commit a felony or misdemeanor within another’s home or business. It is usually an accompanying charge to
presenting a forged check, using a credit card without the cardholder’s permission, destruction or theft of another’s property.
Casino offenses: Gaming offenses will involve the Gaming Control who will seek to revoke
your gaming card if you are an employee. If you are a customer, you can be charged with various casino offenses. Use of “shaved” tokens in slot
machines will result in not only felony theft offenses, but also Burglary. Often, the State will defer prosecution to Federal prosecutors which may
lead to money laundering offenses.
Deportable Offenses: An alien can be deported with the conviction of a theft or violent crime regardless of any probation given. Some crimes do not require any Jail time to be deportable, e.g. solicitation, domestic battery, drugs and firearms offenses, etc. Most criminal attorneys are not aware of the Immigration laws regarding “aggravated felonies” or “crimes involving
Moral turpitude.”
Domestic Violence: Arguments with family members and your significant others can result in
the arrest of one or both persons. Once detained, there is a minimum time in jail before you are released. You need representation because jail time can
be imposed. Additionally, there are statutory minimum sentences which will be imposed if you are convicted.
Drug offense: Drug offenses can be from simple possession of controlled substances to trafficking (Intent to sell) which depend upon the quantity of the controlled substances you have.
Drunk Driving (DUI): Federal and Nevada cases. DUI occurring on Federal lands will be handled in Federal Court. Under Nevada law, first and second DUI offenses are handled
as misdemeanors but a third time offense is considered charged as a felony. DUI involving serious bodily injury or a death are extremely serious.
Juvenile Offenses: Keeping offenses within the juvenile jurisdiction of Family Court and negotiating the offenses will prevent problems. If a minor is certified as
an adult for the criminal offense, the penalties will be greater and more serious.
Probation or Parole: If you are arrested for another crime, you probation or parole may be revoked.
Revocation The probation officer will issue a probation hold upon your arrest. Many judges take the position that probation is a one time chance and when it is revoked, you will be detained and serve your underlying sentence. Don’t take a chance. If you are on parole and you are revoked because you are
arrested again, your sentences will run consecutively, not concurrently.
Solicitation: You can be charged with solicitation even though you did not make the proposition or exchange any money.
Traffic Citations: Avoid points and license revocation problems by letting us negotiate your moving violations to a parking citation in the majority of cases. Traffic citations involving an accident may us to take it to trial to resolve the citation. Often, we recommend retaining an accident re-constructionist to assert your innocence. If you don’t resolve these cases in traffic court, this may lead to problems in your personal injury case.
Traffic Warrants: Not showing up in traffic court or making your payments on time will result in
an Arrest Warrant. DMV will not renew your license and you may be subject
to arrest for any unpaid tickets.
Unprofessional Conduct: If you have a professional license, e.g. physician, chiropractor, dentist, pharmacist or other professional, violation the provisions regarding your profession may lead to the suspension or revocation of your professional license.
Violent Crimes Consult with one of our three attorneys if you are charged with any crime involving violence. Our staff attorneys have experience as a deputy prosecutor or deputy public defender.
White Collar Crimes: Health care & Medicare fraud, Bank Fraud, etc. usually involves federal prosecution. Even innocent negligence in health care billing will lead to
a FBI investigation into your business or profession.
