Immigration Petition:

  1. Petition for Alien Relative
    A citizen or lawful permanent resident of the United States may file to establish a relationship to certain alien relatives who wish to immigrate to the United States.
  2. Petition for Alien Fiancé(e) 
    You may file this petition if you and your fiancé(e) intend to marry within 90 days of your fiancé(e) entering the United States, and are both free to marry, and have met in person with in two years before your filing of this petition unless
  3. Application to Register Permanent Residence or Adjust Status
    Based on an immigrant petition. 
    Based on asylum status.
    Based on refugee status.
    Based on Cuban citizenship or nationality.
    Based on continuous residence since before January 1, 1972.
  4. Application for Naturalization 
    A Lawful Permanent Resident for at least three years
    You have been married to and living with the same U.S. citizen for the last three years, and your spouse has been a U.S. citizen for the last three years;
    A person who has served in the U.S. Armed Forces: You are a Lawful Permanent Resident with at least three years of U.S. Armed Forces service and you are either on active duty or filing within six months of honorable discharge.
    You served during a period of recognized hostilities and enlisted or re-enlisted in the United States. (you do not need to be a Lawful Permanent Resident)
    A member of one of several other groups eligible to apply for naturalization (for example, persons who are nationals but not citizens of the United States). 

Asylum Application (the 5 bases for asylum are):

  1. Race
  2. Religion
  3. Nationality
  4. Membership in a Social Group
  5. Political Opinion. 

    One must prove with documentation, witness testimony and other evidence that ones self or family has been persecuted in their own country in the past and because of that persecution one has a "credible fear" of returning to their home country. 
    For harm or suffering to be considered persecution, it must have be inflicted by either the government or persons or organizations the government is unable or unwilling to control. 

Removal/Withholding and Deportation Matters:

  1. Immigration consequences of criminal convictions: We are able to help you for different removal and deportation matters depending upon the nature and type of the criminal conviction, the date of the conviction, the length of the sentence and the amount involved. Even if granted probation and no fine is imposed, an alien may still be deported/removed if an alien who commits an “aggravated felony” or “crime involving moral turpitude.” This area of the law is extremely complicated.
  2. Persons overstaying their visa are subject to detention, bonding and there are some relief available under asylum, Convention Against Torture (CAT).
  3. Bonding: We can represent you in determining the amount and qualification for bonds for you friends and family detained anywhere in the United States.
  4. Our firm specializes in both criminal law and deportation/removal matters. Often we substitute into the underlying criminal case to modify the underlying criminal conviction or sentence to eliminate the immigration consequences.
  5. Criminal defense attorneys are often unfamiliar with immigration laws. Even a petty offense charge can invoke a Notice to Appear for removal proceedings for aliens.

Work Visas:

  1. Business Visa: You may apply for a Business Visa if you are being transferred from a non U.S. company to a U. S. company, including L1-A International Managers and Executives, E-1 Treaty Trader, EB(5) Immigrant Investors.
  2. H-1B Visa: Your need a four year degree or equivalent to a four year degree to be eligible for the H-1B Visa.
  3. Permanent Labor Certification: If you are hired as a position that a U.S. worker cannot fill; if you are an employer who requests to hire a foreign national because of the shortage of workers in the U.S., you are eligible for the Permanent Labor Certification.
  4. TN visa and TD visa: Contact us for information of TN visa and TD visa if you are Canadian and Mexican Nationals.
  5. EAD or Work Authorization Card.
